A federal court has finalized its ruling on how premium cigars are regulated under the Tobacco Control Act, bringing a long-running legal battle to a close.
In a decision issued by Judge Amit P. Mehta of the U.S. District Court for the District of Columbia, the court reaffirmed that the U.S. Food and Drug Administrationโs Deeming Rule does not apply to premium cigars, as defined in the case. The ruling adopts the same definition the court previously used and declines to make any changes following further review.
The decision comes after the case was sent back by the D.C. Circuit for additional consideration on how premium cigars should be defined. After reviewing input from the parties involved, the court chose to maintain its existing framework.
